Gas Safety Certificate

If your rental property has gas appliances, you must arrange an annual gas safety check carried out by a Gas Safe registered engineer. The result is a Gas Safety Certificate (also known as a CP12).

Legislation

The requirement comes from the Gas Safety (Installation and Use) Regulations 1998, regulation 36. It applies across the UK and is enforced by the Health and Safety Executive (HSE).

What is required

  • An annual gas safety check on all gas pipework, appliances, and flues provided by the landlord
  • The check must be carried out by a Gas Safe registered engineer
  • A copy of the Gas Safety Certificate must be given to tenants within 28 days of the check
  • New tenants must receive a copy of the current certificate before they move in
  • Records must be kept for at least 2 years

Penalties

Failure to comply with gas safety duties is a criminal offence. Penalties can include unlimited fines and up to 6 months’ imprisonment. In serious cases, landlords may face prosecution by the HSE.

You can verify an engineer’s registration and find registered engineers in your area on the Gas Safe Register website. Always check the engineer’s Gas Safe ID card before allowing them to carry out work.
